1. Acceptance of these terms

By registering an account or using the website/app, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the service.

2. Description of the Service

InstantAlert monitors external platforms based on the searches you configure and sends alerts when new, relevant listings are found. We are not affiliated with these platforms.

• Automatic monitoring of your configured searches
• Notifications via email, web push and/or webhooks
• Management of multiple searches and basic history

We may change, extend, or discontinue (parts of) the Service. In case of material changes, we will inform you where reasonably possible.

3. Account and registration

You are responsible for providing accurate information, keeping your login details secure, and for all activities performed under your account. Please report any misuse immediately.

• Minimum age: 16 years
• We may refuse or terminate accounts in case of misuse or violations of these terms.

4. Subscriptions, pricing and payments

Subscriptions are billed monthly or yearly in advance and renew automatically until cancelled via your account settings.

• Prices include VAT unless stated otherwise. VAT is calculated according to applicable rules.
• Payments are processed via Stripe; by paying you agree to Stripe's terms and conditions.
• We will communicate price changes at least 30 days in advance; you may cancel before the new prices take effect.

4.1 Cancellation and refunds

You can cancel at any time; access to the Service will remain active until the end of the paid term. Refunds are not provided, unless required by law or in case of a billing error on our side.

5. Use of the Service (Acceptable Use)

You may only use the Service in accordance with applicable laws, these terms, and the terms of the external platforms we interact with.

• Do not abuse the Service, attempt to break in, reverse engineer, or circumvent technical protections.
• Do not make automated requests that place an unreasonable load on our infrastructure.
• Respect robots.txt, API limits, and terms of the external platforms.
• Use data only within the Service; republication or resale of collected data is not allowed.

5.1 Fair use & limits

We apply limits on the number of searches, frequency, and notifications per subscription. We may throttle or (temporarily) restrict usage to ensure stability and compliance.

6. Intellectual property

All rights to the website, software, and content belong to InstantAlert or its licensors. External listing content remains the property of the respective platforms/sellers.

We grant you a limited, non-exclusive licence to use the Service within the scope of your subscription.

7. Availability and support

We aim for high availability but do not guarantee uninterrupted or error-free operation. Alerts depend on external factors (platforms, providers, network) and may be delayed.

• Maintenance may be scheduled or unscheduled.
• Support is provided via support@instantalert.me; Premium customers receive priority.
• We may temporarily disable features for security or compliance reasons and will inform you in advance where possible.

8. Security

We take technical and organisational measures to protect data. However, absolute security cannot be guaranteed. Please report any vulnerabilities to support@instantalert.me.

9. Data protection and privacy

Our processing of personal data is described in our Privacy Policy. You remain the owner of your data; we only process it to deliver and improve the Service.

10. Liability

The Service is provided on an “as available” basis. We are not liable for indirect damages, consequential damages, loss of data, or loss of profit, unless required by mandatory law.

You indemnify us against claims from third parties arising from your use of the Service in violation of these terms or applicable law.

11. Suspension and termination

We may suspend or terminate access in case of violations, non-payment, misuse, or upon request of authorities. In urgent cases this may occur without prior notice.

12. Changes to these terms

We may amend these terms from time to time. For substantial changes, we will notify you 14 days in advance by email or within the app. Continued use of the Service after the changes take effect constitutes acceptance of the updated terms.

13. Governing law and disputes

These terms are governed by Dutch law. Disputes will be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory law requires otherwise.
